How we collect, use and protect the personal data of auksa.net visitors and our clients.

1. Who we are
The data controller for personal data collected via auksa.net is Auksa sp. z o.o., registered office at ul. Gacka 5-i, 41-218 Sosnowiec, Poland, entered in the register of entrepreneurs of the National Court Register kept by the District Court Katowice-Wschód in Katowice, 8th Commercial Division of the National Court Register, under KRS number 0001255111, NIP 6443601753, REGON 545306702 ("Auksa", "we").

2. Scope of this policy
This Privacy Policy covers personal data processed in connection with: using the auksa.net website, submitting an enquiry through the contact form, delivering ordered Services, and billing for those Services.
This policy does not cover how our clients process data within the systems we build for them — for those systems, the client is the data controller, and Auksa may act as a data processor under a separate data processing agreement.
3. What personal data we collect
Data submitted through the contact form: name, contact details (email or Telegram handle), enquiry topic, budget, and message content.
Data related to delivering a Service: company details, contact person details, technical data shared for the purpose of implementing an integration, and correspondence.
Billing data: information needed to issue an invoice and, via our Payment Providers, payment transaction data; Auksa does not have access to full payment card numbers.
Technical data collected automatically: IP address, browser type, and visit data — as described in Section 7 (Cookies).
4. Legal basis for processing
We process data on the basis of: performance of a contract or steps taken prior to entering into one (GDPR Art. 6(1)(b)) — e.g. delivering an ordered Service or responding to an enquiry; legitimate interest (GDPR Art. 6(1)(f)) — e.g. keeping the Site secure and establishing legal claims; legal obligation (GDPR Art. 6(1)(c)) — e.g. tax and accounting requirements; and consent (GDPR Art. 6(1)(a)) — where required, such as optional marketing consents.
5. How we use your data
We use your data to: respond to enquiries submitted through the contact form, prepare proposals and deliver ordered Services, handle billing and issue invoices, keep the Site secure and functioning correctly, and meet legal obligations (e.g. tax obligations).
We do not use data submitted through the contact form for automated decision-making that produces legal effects concerning the Client.
6. Payment data
We settle against invoices paid by bank transfer. For that purpose we process the data needed to issue and reconcile an invoice: company name, address, tax number and the account a payment arrived from.
Auksa neither processes nor stores payment card numbers or CVV codes.
If we make online payment available in future, it will be handled by an external Payment Provider — card details would then go directly to that provider and never pass through Auksa's servers, and we would receive only the transaction status and the data needed for the invoice. The provider's name and a link to its privacy policy will be stated in this section before such a method is offered.
7. Cookies
The Site does not currently use cookies — the selected language is stored in the URL, not in a cookie. If we introduce cookies that are strictly necessary for the Site to function, or third-party analytics or advertising cookies, the Site will show an appropriate consent banner where required and this section will be updated accordingly.
You can configure your browser to block or delete cookies, though this may affect how the Site functions.
8. Sharing data with third parties
Data may be shared with: the bank holding our account, in order to settle payments; technical infrastructure providers (hosting, email, Telegram — to the extent the contact form delivers enquiries via the Telegram Bot API); our accounting provider for tax purposes; and public authorities where required by law.
We do not sell personal data to third parties or share it for marketing purposes without separate consent.
9. International data transfers
Enquiries submitted through the contact form reach us via the Telegram Bot API, and Telegram processes data outside the European Economic Area. Some of the technical infrastructure providers we use may also process data outside the EEA.
Where this happens, the transfer relies on mechanisms that ensure an adequate level of data protection, such as Standard Contractual Clauses approved by the European Commission. If you would rather your data did not travel that route, write to us directly at support@auksa.net instead of using the form.
10. Data retention
Data from enquiries submitted through the contact form that did not lead to an engagement is retained for 12 months from the last contact, after which it is deleted or anonymised.
Data related to delivering a Service and to billing is retained for the period required by applicable tax and accounting law (typically 5 years from the end of the year in which the transaction occurred).
11. Your rights
Under the GDPR, you have the right to: access your data, have it corrected, have it erased, restrict its processing, receive a copy in a portable format, and object to processing based on legitimate interest. Where processing relies on consent, you may withdraw it at any time.

You also have the right to lodge a complaint with the data protection supervisory authority — in Poland, this is the President of the Personal Data Protection Office (UODO).
12. Children's privacy
The Site and Auksa's services are addressed exclusively to businesses (B2B) and are not intended for individuals under the age of 18. We do not knowingly collect personal data from minors.
13. Changes to this policy
We may update this Privacy Policy from time to time, in particular to reflect changes in the law or in the scope of services we offer. The current version is always available on this page, together with the date of the last update.
